Can my mom send me away to my dad?

My parents are devoiced and i live with my mom. All the time when i misbehave or act up or even talkback she would then threaten me with sending me to my father which i don t want. I never seen my dad in like 8 years and she always bring it up. The i don t think they got married legally thus they ever got divorced legally, my dad never pay child support and I never seen him. So my question is, can my mom really send me away to my dad or its really my decision on who i want to live with for now. and plz i know its sounds bad but please i want a logically answer nothing emotional
